These are the guidelines by which we deliver our goods to you. Please read these terms carefully before placing an order with us. These terms explain everything you need to know about purchasing from us. We reserve the right to update these terms and conditions at any time by publishing updated terms and conditions of sale on our website. The terms and conditions posted on the website or app at the time you place your order will govern that purchase.

2. Making a purchase  (online Order)

2.1. How to Place an Order Orders can be placed via our website or app. Once you've added the product(s) to your cart, you'll be taken through our checkout process, where you'll be required to enter your contact information, delivery and billing information. Please check, double check, and even triple check your order (for example, the product(s), size(s), and delivery address) before clicking the "complete order" button or the "pay now" button if using Apple Pay.

2.2. Order acceptance Your order represents an offer to us to purchase the product(s) in your cart We will send you an email confirming receipt of your order after you place it.

Our official acceptance of your order occurs in the United Kingdom when we send you an email to confirm that we've shipped your product (s). It is at this point that a contract between you and us will be formed. We will confirm your order number when we acknowledge your order. If you need to get in touch with us about your order, please use this order number.

2.3. Order placement restrictions To order our products, you must be at least 18 years old and authorised to use the payment method that you intend to use. If you are under the age of 18, you may only place an order with the involvement of a parent or guardian.

3. Your order's cancellation rights

3.1. If we are unable to fulfil your order. If we are unable to fulfil your order (for example, because the product is out of stock, we were unable to verify the billing information you provided, you requested delivery to a country that we do not currently ship to, or there was an error in the pricing or description of the product), we will notify you via email and will not charge you for the product.

3.2. Suspicious or unusual activity We only sell our products for personal use. We reserve the right to cancel an order if we notice something unusual or suspect that our products are being used for commercial, business, or resale purposes. 

3.3. In case of Suspension of product supply   We may have to discontinue the supply of a product to you in order to:

3.3.1. resolve technical issues or make minor technical changes;

3.3.2. update the product to reflect changes in applicable laws and regulations; and/or

3.3.3. make changes to the product as we notify you.

4. Our Product

4.1. What we offer. We sell fitness gear, including clothing and accessories.

Descriptions of our products (4.2). The images of our products (and packaging) on our website and app are purely illustrative. We work hard to ensure that colours are displayed accurately, but we cannot guarantee that the colours displayed by a device exactly match those of our products.

4.3. Gift vouchers You can buy a gift card (in the form of a digital code) from us in the same way you buy any of our other products.

4.3.1. You cannot pay for a gift card with another gift card.

4.3.2. The total daily limit for gift card purchases is $3,000 per person;

4.3.3. gift cards are valid for 5 years from the date of purchase (unless extended by applicable state laws); and

4.3.4. Gift cards can only be used at the local online store where they were purchased (for example, gift cards purchased from Gymdady.com UK or  UK as the browsing country can only be redeemed on the gymdady.com UK store or on our app using the Uk as the browsing country).

5. Shipping

5.1. Delivery location We ship to the United Kingdom for orders placed on our Gymdady.com website.

The risk of loss for products purchased from us passes to you when we deliver them to the carrier. The ownership of products purchased from us passes to you upon the payment of the Product.

5.4. When will we deliver the products? The delivery method you select during the order process will determine when we deliver the products to you. If you purchase products during promotional periods, it may take a little longer for us to deliver them to you.

5.5. We are not liable for delays that are beyond our control. If delivery of the products to you is delayed due to an event beyond our control (for example, postal/courier delays, logistics, or bad weather), we will notify you as soon as possible. If there is a significant risk of delay, please contact us to cancel your order and we will refund you the difference.

If you are not present when the product is delivered. If no one is available to accept delivery and the products cannot be posted through your letterbox, the courier will notify you of the attempted delivery and instruct you on how to reschedule delivery or collection of the products.

6. Your legal rights

6.1. If the product you purchased is faulty or differs significantly from how it is described on our website or app, you may have a legal right to have it replaced or refunded. In this case, the return will be free in the United States if you return the product to us within 30 days (unless otherwise stated on our website) of the date of receiving product.

6.2. If you wish to terminate the contract for any of the reasons listed below, the contract will be terminated immediately, and we will refund you in full for any products paid for but not delivered to you. The following are the reasons:

6.2.1. we have informed you of an upcoming change to the product or these terms with which you disagree;

6.2.2. we informed you of an error in the price or description of the product you ordered, and you refuse to proceed;

6.2.3. we have informed you that product supply may be significantly delayed due to events beyond our control;

6.2.4. We have halted product supply for technical reasons.

or notify you that they will be suspended for technical reasons for a period of more than four weeks; or

6.2.5. You have the legal right to terminate the contract because of something we did not meet compliance.

6.3 If you have changed your mind about the product, please explain why. We provide a goodwill guarantee that allows you to change your mind within 30 days of receiving the products (unless otherwise stated on our website or app). If your products are delivered on different days, you have 30 days (unless otherwise stated on our website or app) from the day you (or someone you nominate) receive the last delivery to change your mind. In either case, you will be responsible for the cost of the return. Please keep in mind that some products, such as:

6.3.1. products that have been unsealed after being sealed for health protection or hygiene purposes (e.g., swimwear, underwear, or socks).after you receive them, if they are not in their original packaging, or if any tags or the hygiene slip have been removed;

6.3.2 Water bottles that have been opened or used in any way;

6.3.3. any product whose care label has been cut and/or removed;

6.3.4. any product that is missing any component part(s) when returned by you (unless this is due to our error);

6.3.5. any products that become inextricably mixed with other items after delivery; and

6.3.6. any items labelled "final sale"

In all other cases (if we are not at fault and there is no right to change your mind). Even if we are not at fault and you do not have the right to cancel the contract, you may do so before the products are delivered and paid for; simply contact us to let us know.

7. Refunds and returns

7.1. Inform us that you wish to terminate the contract. To terminate your contract with us, ask us any questions, or if you have any complaints about the product, please contact our customer service team via our online form at gymdady.com/contact, the support section, or any of the other options on our website.

7.2. Returning products after the contract has expired. If you cancel the contract for any reason after the products have been shipped or received, you must return them to us. Our Returns Policy outlines the procedure for returning products to us. Visit our Returns Portal at gymdady.com/returns , enter the necessary information (including the product(s) you are returning and the reason(s) for the return), and follow the relevant instructions, including printing a returns label (if specified).

Following that, you should drop off the package containing the product(s) you're returning (with the returns label securely attached) at one of the collection points we provide you with. Unless otherwise stated on our website 

Please ensure that the products are returned to us within 30 days of receiving them. We reserve the right to refuse returns/exchanges for any reason, with or without receipts.

7.3. When and how will we refund you? We will refund the price you paid for the products (excluding any applicable delivery costs) using the same payment method you used. When using a part-card and part-gift card to make a purchase, the refund will be applied to the gift card first. If you used a discount code to purchase the product, the amount refunded will be reduced to reflect the benefit of any discount received when purchasing the product. Any refunds owed to you will be processed as soon as possible. 

You are exercising your right to cancel, and your refund will be issued within 14 days of receiving the unused product from you.

8. Our contract termination rights

8.1. If you breach the contract, we may terminate it. We may terminate the contract for a product at any time by notifying you in writing if:

8.1.1. you fail to provide us with information necessary for us to provide the products, such as the delivery address, within a reasonable time after we request it; or

8.1.2. you do not allow us to deliver the products to you within a reasonable time frame.
